This website (www.tarkerfurniture.com) is owned and operated by Tarker Furniture Pte. Ltd., a Singapore registered company under the Business Registration Number 202030237G.

These Terms set forth the terms and conditions under which you may use our website and services as offered by us. By accessing or using the website of our service, you approve that you have read, understood, and agree to be bound by these Terms.

Our service availability

Our website is only intended for use by people residing, businesses, and companies in Singapore (“the Serviced Country”). We do not accept orders from individuals outside of the Serviced Country.

Contract Formation

After placing your order, we will send you an order acknowledgement e-mail with your order number and details of the Product you have offered to purchase. The acceptance of your order, and the contract of sale of the Product between you and us will only place, when you receive a confirmation from us that the Product have been shipped to you from our warehouse.

Products

Variation in wood color tones, woodgrains and natural wood features (i.e. knots and nicks) in Products are possible as a result of the nature of each wood piece used. These variations are inherent to each and every unique wood piece, and therefore these are in no way considered defects.

Minor differences in color are possible as a result of photoshoot lighting, display technologies and other technical reasons.

All Products shown on our website are subject to availability. A Product may no longer be available for purchase, though we strive to ensure our website reflects the actual stock availability. We will contact you in the event of the Product that you have offered to purchase is, either:

  1. Running out of stock

    We will advise you on the next possible restocking date. Upon your confirmation and agree to receive the Product on next possible restocking date, we will proceed with your order. Otherwise, we will refund to you the amount paid within 7 working days. 

     

  2. No longer available

    We will refund to you the amount paid within 7 working days.

Price

The price of any Products shown on our website are quoted in Singapore dollar (S$), and the Products are priced as quoted on our website, unless in cases of error. Although we always strive to ensure our website reflect the correct price, a Product may be incorrectly priced. We will verify the price after you have placed your order. We will contact you in the event of the Product that you have offered to purchase is, either:

  1. Priced higher than the correct price

    We will refund to you the excess amount paid within 7 working days.

     

  2. Priced lower than the correct price 

    We will request you to top-up the difference before processing your order; or reject your order if you wish not to top-up the difference, and we will refund to you the amount paid within 7 working days.

Change or Cancellation of Order

If you wish to change or cancel your order, please contact our Customer Service. We are happy to process your request before your order has been shipped out from our warehouse.

  1. For change of order before the order has been shipped: We can change your order, and you may be required to top-up the difference if the total amount of amended order is higher than the original order. In the case of the total amount of amended order is lower than the original order, we will refund to you the excess amount paid within 7 working days.
     

  2. For change of order after the order has been shipped: Unfortunately, we are unable to change your order as your order would already on its way to you. You may return any Products you don’t want by following our Returns policy after receiving your order.
     

  3. For cancel of order before the order has been shipped: We can cancel your order and we will refund to you the amount paid within 7 working days.
     

  4. For cancel of order after the order has been shipped: Unfortunately, we are unable to change your order as your order would already on its way to you. You may return any Products you don’t want by following our Returns policy after receiving your order.

Limited Liability

Your use of our website is at your own risk. To the extent permitted by law, our liability in connection with any Product or Service purchased through our website is strictly limited to the purchase price of that Product or Service. 

Force Majeure Event

We will not be liable for any delay or failure to fulfil our obligations under these Terms due to causes beyond our reasonable control. 

Waiver

No term of these Terms and Conditions shall be deemed waived unless it is stated to be a waiver and is communicated to you in writing. No failure or delay by us to exercise any right or remedy provided under these Terms or by law shall constitute a waiver of that or any right or remedy.  

Severance

If any provisions of these Terms are deemed invalid, unlawful or unenforceable, such provisions shall not affect the enforceability of any of the other provisions to the maximum extent permitted by law.

Amendments

We reserve the right to modify these Terms and Conditions at any time at our sole discretion. The use of our website and any contract of sale executed between you and us, will be subject to the version of Terms and Conditions in force at the time you place your order with us. You can always check and review these Terms and Conditions to find out the changes and updates.

Applicable Law and Jurisdiction

These Terms and Conditions as well as contract of sale executed between you and us, shall be governed by the laws of Singapore. Any dispute which may arise under these Terms and Conditions or such contract, shall be under the non-exclusive jurisdiction of the Courts of Singapore.
